Under this pillar, we act for
clients raising capital using either
equity or debt structures, or a combination of both.
Whether you are start-up company, a top 100 listed entity, or
something in between, we provide our specialised legal services
where you wish to raise capital.
Money can be raised in many ways, including–
-
through an issue of ordinary shares or some other form of shares,
such as a preference share
-
through a debenture program,
which is an issue
of debt, or
-
through a form of hybrid
security such as a converting note, which starts life as a debt
instrument but later converts to equity.

Our litigation and risk
management services supplement our expertise in the commercial areas
in which we practice. While litigation is not something people
generally set out to engage in, sometimes it is forced upon them as a
way to resolve a
dispute or force a result in a contentious
transaction.
The best results in litigation
are possible where there are litigation specialists working
side-by-side with commercial lawyers who have a thorough understanding
of the commercial matters involved.
Risk management is another
important component of this division in McMahon Clarke Legal. The
services we provide here give our clients the best chance of avoiding
potential disputes, or minimising the potential for damaging
consequences.

Complementing both the direct property

Within this section, we have a particular focus on the stamp duty

correctly can be horrendous, so it is important to get the right
advice upfront.

We provide commercial and practical
advice to complex problems in a timely and cost effective manner. As
specialists in our chosen field of expertise, we can afford to
spend time on research and development of legal
issues so our team of lawyers can provide
you with the answers to your questions quickly and more cost
effectively than our competitors. For example, this means you do
not pay high hourly rates for our
time while we learn about an area of the law,
which would penalise you just because you were the first person to raise a complex
problem with us.
We enjoy the freedom specialisation brings.
In particular, the freedom to know we can spend time to consider
all aspects of an issue knowing the result of our work will be a
better outcome for our clients who may ask us about the issue in the future.
Each time we are engaged, you will be told who will
be working on the matter and the names and direct lines of all of the
people you may need to contact throughout the matter.
On project and advice work, we provide you with a
fixed fee proposal before we start work and take time to step out the
scope of work we will complete for you. Our fees will change if the
scope of work changes throughout the matter. We also give you a
detailed time line so you know when key steps in the matter will be
completed.
We only charge hourly rates in matters such as
litigation, negotiations with third parties and other circumstances
where we do not control the approach being taken by others involved in
the matter. However, even in these cases we provide you with realistic
estimates of those fees.
Accounts are generally rendered on a monthly basis,
although this can vary on a case-by-case basis.
Our clients are drawn from all commercial sectors of the economy,
including funds management, financial services, rural and
agribusiness firms, property development and management, private
equity and venture
capital, accounting, legal and other professions.
Whether you are a top 100 listed company or a small operator with a good idea to start a new business venture, our commitment to
service delivery for you is the same.
