Experience: Brendan actively assists clients with the establishment and operation of managed funds as well as advising clients on banking and finance transactions related to managed investment schemes. His work involves:

  • Preparation of, and advice on, applications for Australian financial services licences.
     
  • Preparation of documents for the establishment of managed investment schemes such as constitutions, compliance plans, investment management agreements and asset management agreements.
     
  • Drafting and reviewing banking and finance documentation, such as fixed and floating charges, facility agreements, mortgages, guarantees and indemnities, featherweight floating charges, deeds of priority and subordination and share charges.
     
  • Advising clients on their security position in relation to finance structures and advising on financing restructures.
     
  • Advising fund managers, responsible entities, custodians and trustees in relation to all aspects of lending to, or borrowing from, managed investment schemes.
     
  • Drafting and reviewing offer documents for managed investment schemes.

Brendan joined the funds management team in 2007. Prior to this, he practised in Sydney advising on large commercial property and development acquisitions as well as representing clients in contested court matters in the State, Federal and High Courts.

Professional Qualifications: Bachelor of Laws, Bachelor of Business (Banking and Finance) (Distinction) and Graduate Diploma in Legal Practice.
